Prosecutors will ask the Illinois Supreme Court to review an appellate court opinion that found former Sangamon County deputy Sean Grayson should be released from jail pending trial for murder.

Capitol News Illinois reports prosecutors asked for a stay of that order, noting if it was allowed to stand, there was a high likelihood of upheaval in the community. The motion also stated that there is a significant chance the supreme court would reverse it.

The appellate court found the trial judge’s ruling to detain Grayson hinged on his status as a police officer and failed to demonstrate that he continued to pose a threat as a private citizen.

Grayson was fired after he was charged with fatally shooting Sonya Massey, an unarmed Black woman, in her kitchen after she called to report a prowler.

Grayson was back in court Monday for a hearing in his case.
