A Shelby County criminal case that could have resulted in prison time instead generated probation.
21-year-old Tyler Davis of Decatur, formerly of Shelbyville, was arrested in 2022 on 17 child pornography charges, many of the charges Class X felonies meaning mandatory prison time.
Instead, the charges were dismissed in December and replaced by a misdeanor charge of public indecency. Davis pleaded guilty to the new count and has been placed on 12 monhs' probation, will have to complete 45 days' community service work, and was fined.
Shelby County State's Attorney Robert Hanlon said the dismissal of the original charges was an "evidentiary matter." Hanlon said of the new charge he filed, "This is what I had evidence of." He said the original information gathered was not something he felt he could use.
Hanlon did say that Davis did not produce the child pornography. The actions alleged occurred in September of 2021.
