Hearing Set in Circuit Court to Reconsider Ruling on Assault Weapons Ban

A hearing has been scheduled for the new year in the suit filed by Accuracy Firearms and many other plaintiffs regarding the Assault Weapons Ban.

4th Circuit Chief Judge Douglas Jarman dismissed the suit earlier this year following similar action by the Illinois Supreme Court. Greenville attorney Thomas DeVore then filed a motion asking Jarman to reconsider the ruling to dismiss. The judge allowed attorneys for both sides time to file their pleadings in the matter, and that was completed earlier this month.

On Thursday, a hearing was scheduled for 1pm on January 3rd to consider the request to reconsider Jarman's motion to dismiss the suit.

Since the rulings were made in the state court, the US Circuit Court of Appeals offered a similar decision, but that decision is expected to be appealed to the US Supreme Court.
