Motion to Suppress Denied in Glass Case

Judge Kimberly Koester Monday ruled against a defense motion to suppress statements made during a police interview by murder suspect Christopher Glass, allowing the case to move ahead to trial.

Glass is charged with three counts of first degree murder, as well as concealment of homicidal death and a parole violation. The 36-year-old Mason resident is accused of shooting Kimberly Mattingly of Paris in April, then helping dispose of her body on property near Beecher City.

Effingham County Public Defender Scott Schmidt contended that when Glass stated during the interview with authorities after his arrest in Terre Haute in April that he was done talking and the interview was over that the continued conversation that followed was a violation of his Miranda rights, and suggested the entire conversation should be disallowed.

Judge Koester agreed with State's Attorney Bryan Kibler, though, that Glass continued to discuss the matter for another hour after saying the conversation was over and rejected Schmidt's contention that Glass was under the influence of methamphetamine when the converation was being conducted.

The judge scheduled Glass' trial for January 25, with a final pre-trial hearing on January 14.

Glass remains in custody under $5 million bond.
