Oral Arguments Set for October 14 in Bailey vs. Pritzker Case

Oral arguments are to be heard October 14 in the case of St. Rep. Darren Bailey vs. Governor J.B. Pritzker.

Bailey has charged that the governor exceeded his authority in issuing supplemental executive orders regarding COVID-19 after his original order expired in the spring. Bailey's case, and those filed elsewhere in the state containing similar allegations, were all moved by the Illinois Supreme Court to Sangamon County for litigation.

Pritzker, through the Illinois Attorney General's office, is seeking to dismiss the suit filed by Bailey. Bailey's attorney Thomas DeVore was given until September 21 to respond. The Attorney General's office was given until October 5 to file information in support of the petition to dismiss the case.

Bailey is also seeking a substitution of judges to hear his case.

Meanwhile, the state Supreme Court is to rule in an attempt to clarify the situation, which involves cases from a number of counties in downstate Illinois.
