Hearing in Bailey v. Pritzker Case Tomorrow

A hearing is set for tomorrow to consider Governor J.B. Pritzker's request for an extension of time to respond to State Representative Darren Bailey's request for a substitution of judge in their case.

Bailey's case alleging the governor doesn't have authority to continue issuing emergency orders concerning coronavirus disease was moved from Clay County to Sangamon County. The Illinois Supreme Court's decision was part of consolidating all cases involving similar challenges to the governor's authority.

Bailey has subsequently asked for a different judge to hear his case. The Court had ordered the governor to respond to the motion by last Friday. On Friday, though, the governor asked for the extension of time.

The hearing on the governor's request is set for 1:30pm Wednesday.
