Additional Count Filed by Bailey Against Pritzker in Clay County

St. Rep. Darren Bailey has filed a response to the State's motion to dismiss the unresolved count in the lawsuit brought by Bailey against Gov. J.B. Pritzker.

The suit was brought by Bailey that he did not have to comply with Pritzker's stay at home orders. 

Two counts in the suit in Clay County were decided in Bailey's favor and one in the Governor's favor, while a summary judgement was returned in the other count. The State then filed a motion to dismiss that other count. Bailey's counsel, Thomas DeVore Wednesday filed a response to the motion to dismiss, and also filed an additional count in the suit.

Judge Michael McHaney is now handling daily call cases in Effingham County, so the Chief Judge's Office will determine when the matter will be heard next in Clay County.
