Bailey, Pritzker Await Ruling on Location for Lawsuit

Attorneys for St. Rep. Darren Bailey and Gov. J.B. Pritzker have filed documentation; now it's up to Federal Magistrate Gilbert Sison to decide whether a lawsuit brought by Bailey against the governor should be heard in Federal Court or in Clay County Circuit Court.

Bailey sought and received a Temporary Restraining Order against having to comply with the governor's stay at home order. Bailey later declined the TRO and instead filed an amended lawsuit before the matter of a permanent injunction against compliance with the order was argued in court.

In the meantime, the Illinois Attorney General's office and the governor sought to move the case to Federal Court. Bailey objected to moving the case out of Clay County Circuit Court and that's where the case stands.

What's believed to be the last of the necessary filings was lodged by the Attorney General's office on Monday, so now it's up to the magistrate to decide.
