Hearing Challenging Pritzker's Order to be Heard Monday in Clay County Court

A first hearing in the case challenging the legality of Governor JB Pritzker’s ‘stay at home’ order. is set for today at 1:30 in Clay County Court in Louisville.

State Representative Darren Bailey of Xenia says he is confident the law is on his side. 

Bailey notes an internal memo from the Chief Deputy Director of the State’s Attorney Appellate Prosecutor’s Office David Robinson who was quoted as saying his research leaves him less than confident that a reviewing court will hold that the Governor has the authority to close businesses, bar attendance at church services and assemblies in excess of ten citizens particularly if they are assembling to redress grievances.

Robinson says it appears the emergency powers act the Governor is relying only allows a maximum 30-day window. Robinson’s comments first appeared publicly on the Edgar County Watchdogs website.
