Person w/Gun at Boos Factory Outlet Will Not Be Prosecuted

Effingham County State's Attorney Bryan Kibler will not be filing charges against a Michigan man whose gun discharged during an incident at John Boos Factory Outlet in Effingham.

The incident occurred January 11. Effingham City Police Chief Jason McFarland said the man, 60-year-old Randolph Brohl of Flat Rock, Michigan, had his handgun in his jacket pocket. A Boos employee, 61-year-old Nick J. Nichols of Toledo, was helping Brohl with an item he had purchased. The item struck Brohl's jacket, causing the gun to discharge. The bullet struck and wounded Nichols. 

Nichols was admitted to Carle Foundation Hospital in Urbana for treatment.

McFarland said Brohl had a Michigan concealed carry permit, and was in compliance with Michigan laws. He said he was in agreement with the decision not to charge Brohl in the incident.
