No More Charges Expected in Hearty Death

No further charges are expected in the death of Altamont resident Jason Hearty.

Hearty was fatally injured the morning of March 28, 2016. He was traveling westbound on Route 40, heading to his workplace in St. Elmo, when his bicycle was struck by a semi that left the scene. Hearty was pronounced dead at the scene about an hour after he was found.

Fayette County State's Attorney Joshua Morrison said he has reviewed evidence gathered by Illinois State Police and said there is nothing to indicate the trucker, 31-year-old Kevin Bagwill of Godfrey, should be charged with anything other than failing to report the accident. It was still dark at the time of the crash.

State police located Bagwill in the Metro East area around noon the day of the incident and recovered the semi involved.. He was arrested on counts of leaving the scene of a fatal crash and failure to report the accident. Morrison later dismissed the leaving the scene count, which was a felony offense.

Bagwill is due in court on the failure to report count on July 13. The case has been on hold until all of the evidence in the case was in.
