The 57-year-old Pendergast is charged with injuring Corey Stice of Effingham during an altercation at a local residence May 16. Stice died on May 18. State's Attorney Bryan Kibler has indicated the matter is not a first degree murder case and has indicated no additional charges are likely at this time, citing additional circumstances in the case.

Pendergast's bond is set at $100,000. He did not indicate what sort of reduction in bond he might be seeking.

Pendergast is next due in court on June 13 at 11am for a preliminary hearing. No trial date has been set.
