Kinmundy Man Charged w/Sex w/Underage Girl

A 55-year-old rural Kinmundy man had bond set at $100,000 after being formally charged in Marion County Court Monday for alleged criminal sexual assault, aggravated criminal sexual abuse and giving or selling alcohol to a minor.

Terry Mulvaney is accused of having sexual relations with a 16-year-old girl during a party at his home in June. The girl was a friend of Mulvaney's son.

Marion County State's Attorney Matt Wilzbach believes the girl may have been drugged because after being given a drink she didn't remember what happened.

The Class 1 felony criminal sexual assault charge claims she was not in a condition to give consent. The aggravated criminal sexual abuse charge is based on Mulvaney being more than five years older than the victim.

The Marion County Sheriff's Department did not receive a report about the allegations until Thursday after the girl told her parents what happened and they brought her to the sheriff's department.

Mulvaney was taken into custody on Friday after questioning.

If released on bond, Mulvaney was ordered to have no contact with anyone under the age of 18. The public defender was appointed to represent him. A preliminary hearing in the case is set for September 29th.
