Cisney Withdraws Guilty Plea, Possible Sentencing Hearing Tuesday

The case of a Hidalgo man, charged with two counts of sexual abuse, could be set back to pre-trial status if a judge accepts the defense's most recent motion.

Charles Cisney, 51 OF Hidalgo, had pleaded guilty to two counts of aggravated criminal sexual abuse involving a then 16-year old male in the summer of 2003. He was arrested in July 2014 on counts of sexual assault, and pleaded guilty to the lesser charge of abuse.

Now, Cisney is attempting to withdraw his guilty plea. 

Jasper County State's Attorney Chad Miller explained to us via phone Thursday morning, that if the judge in the case accepts Cisney's plea withdrawal, it effectively moves the case back to a pre-trial phase, restarting the process and paving the way for a possible trial. If the judge does not accept with withdrawal, the case would then move to the sentencing phase. Miller added that Cisney could also plead guilty again to the charges.
