Another Possible Conflict in Marschke Case; Miller Case Re-Scheduled

Another possible conflict for the attorney tabbed to represent Richard Marschke.

The 32-year-old Vandalia man is charged with drug induced homicide for allegedly providing the heroin that led to the death of an Altamont man. The problem has been finding him a court-appointed attorney. Public Defender Scott Schmidt has a conflict so Conflicts Public Defender Richard Runde was appointed to the case. Runde had a conflict, so local attorney Ed Deters was appointed, but his law firm had ties to the family of the victim, so he was replaced by Aaron Jones, but Jones Thursday indicated his law firm might have conflicts. Jones was directed to put the potential conflicts in writing. The matter will be considered September 23 and if the request to be removed from the case is granted, it could be on to a fifth attorney to represent Marschke.

Meanwhile, Jay Miller of Altamont was due in court this morning on counts of aggravated intimidation and aggravated battery, but the paperwork was never completed requesting he be brought from prison for the hearing, so the matter was continued to September 24.

Miller was found guilty of drug induced homicide for providing the heroin that led to the death of an Effingham woman earlier this year. The new charges stem from an alleged attack on a fellow inmate who testified at Miller's trial.
