Halbrook Signs Onto Recall Legislation

Representative Brad Halbrook (R-Shelbyville) today announced his co-sponsorship of House Bill 5924: The Local Government Elected Official Recall Act, and a companion Constitutional amendment resolution to empower Illinois voters and enhance accountability for elected officials across all levels of Illinois government.

Halbrook said the proposed initiatives establish a framework for the recall of state and local officials, expanding existing recall mechanisms and ensuring consistent processes throughout Illinois. He said, "These efforts underscore a commitment to safeguarding democracy and strengthening public trust in government."

“This legislation ensures that every elected official, from local leaders to state executives, remains fully accountable to the people they serve,” Rep. Halbrook said.

Key Features of HB 5924: Local Government Elected Official Recall Act include:

Expanded Recall Authority: Allows the recall of local officials elected in general or consolidated elections, providing voters a mechanism to hold leaders accountable.

Clear Petition Requirements: Petitions must be signed by 10-30% of electors and filed within 90 days of notice to circulate. They must include statements outlining grounds for recall.

Efficient Election Process: Recall ballots include statements from petitioners and officials for transparency. Replacement candidates will be listed on the same ballot, simplifying transitions.

Statewide Consistency: Limits home rule powers to regulate recalls, ensuring uniform processes across all jurisdictions.

Accountability Enhancement: Officials removed via recall will be barred from holding public office for 10 years.

The accompanying Constitutional resolution would expand recall authority beyond the Governor to include state executive branch officers, legislative leaders, the Illinois Auditor General and local officials. Recall elections require a three-fifths majority to remove an official.
