The juvenile charged in the shooting death of 16-year Kaylee Jacob of Effingham was in court Wednesday.

Effingham County Public Defender Scott Schmidt, representing the 16-year old minor, told Judge Kimberly Koester that findings from a previously ordered psychological evaluation had not been "put to paper", and asked for the case to be continued into early 2016.

Schmidt also presented a motion for the juvenile to be released to the custody of his father, with a mention that school is not in session due to the holiday break, and that the boy hasn't had any behavioral issues during the two months he's been detained.

Prosecutor Regina Jeon said the State strongly objected to the motion. Jeon said it's "irrelevant how he's doing in custody", and that the probation department doesn't currently have an electronic monitoring system available for use.

Jeon also added that the victim's family had not been made aware of the request, and that the court has yet to hear a previously filed motion by the State to have the case transferred to adult court.

Koester denied the request, "based on the seriousness of the offense."

The 16-year old is charged with involuntary manslaughter, reckless discharge of a firearm, possession of a stolen gun and burglary.

The minor will next be in court on Wednesday, January 6, when findings from the psychological evaluation are expected to be presented.
