Efforts continue to secure an attorney for Vandalia resident Richard Marschke, charged with drug induced homicide in the death of an Altamont man early this year.

The 32-year-old Marschke has had a number of court-appointed attorneys, but all have had conflicts. The latest is Aaron Jones, whose law firm has represented the alleged victim in the case or his family in various legal matters.

During a brief hearing Tuesday morning, Judge Allan Lolie said Jones' motion to withdraw from the case was "well-taken" and was granted.

The judge said the Court is "running out of lawyers on the list" of those attorneys who have signed up to serve as court-appointed counsel in case of conflicts. He said he has conferred with Resident Circuit Judge Kimberly Koester and said the Court hopes "to have (the matter of an attorney) decided this week and back on track."

Judge Lolie scheduled a hearing for 11am on Thursday, September 25 at which time it's hoped an attorney will have been secured.

Marschke is still scheduled to go on trial October 6, but that's highly doubtful with the delays in the case.
