Miller Trial Confirmed for June 2

The trial of Jay Miller of Altamont has been confirmed for June 2.

The 22-year-old Miller is charged with two counts including drug-induced homicide in the death of an Effingham woman.  Authorities believe Miller supplied the heroin that led to the woman's death.

Attorneys argued during a pre-trial hearing Friday morning as to whether electronic messaging should be introduced as evidence during Miller's trial.  Judge Kimberly Koester, who will preside over the trial, ruled that the electronic messaging information could be used during trial as long as proper foundation is laid.

Miller remains in custody in Effingham County Jail after earlier pleading guilty to a count of possession of controlled substance.  He was sentenced to five years in prison, but officials allowed him to remain at the local jail since his trial was to begin soon.  If Miller is found guilty and is sentenced to prison time on the additional charges, the sentence would run concurrent with the sentence already imposed.
